Trex decks and fencing products class action lawsuit settled

Many consumers in Minnesota and across the United States use decking materials from a popular brand, known as Trex, to enhance their patios and homes. Some of them may qualify for compensation after a court recently approved a settlement in a nationwide class-action lawsuit against the company. Certain Trex brand decks and fencing products were reportedly found to be prone to color variation and fading, as well as the growth of mold.

The lawsuit alleged that Trex composite products purchased between Aug. 2004 and Aug. 2013 were defective. Rex could face payouts for as much as $8.3 million in the settlement. Additionally, the company could be required to pay $1.5 million to cover the attorney fees of the plaintiffs in the suit.

Trex denied liability but has agreed to the terms of the settlement in an attempt to avoid further litigation. The company must provide the plaintiffs relief in the form of cash compensation or rebate certificates. The Chief Executive for Trex indicated that the company is pleased with the resolution and believes that the settlement terms are fair to everyone involved.

When Minnesota homeowners purchase decks and fencing products, such as those manufactured by Trex, they are placing their faith in that company to provide a quality product. Defective products can be dangerous to consumers, both physically and financially. Seriously defective products sometimes spawn class action lawsuits similar to the one brought against Trex. For consumers, the process can seem tedious and challenging; fortunately, successful litigation of a class action lawsuit may result in consumers finding financial relief.
